B\u00f6ylesine \u00f6nemli ve bir o kadar da geni\u015f olan bu konuyu \u00fcst\u00fcn k\u00f6r\u00fc ge\u00e7mek elbette pek m\u00fcmk\u00fcn olamayacakt\u0131r. Bu nedenle bug\u00fcn hasta hekim ili\u015fkilerinin bir par\u00e7as\u0131 olan, belki de zaman zaman g\u00f6z ard\u0131 edilen hasta haklar\u0131na ve bu haklar\u0131n ge\u00e7mi\u015fine de\u011finelim istiyorum.<\/p>\n\n\n\n<h2><strong>HASTA HAKLARI TAR\u0130H\u0130<\/strong><\/h2>\n\n\n\n<p>Hasta haklar\u0131n\u0131n nas\u0131l ortaya \u00e7\u0131kt\u0131\u011f\u0131n\u0131 ve geli\u015fim ser\u00fcvenini daha iyi kavrayabilmek ad\u0131na tarihteki hasta-hekim ili\u015fkisinden biraz bahsetmekte yarar var. Hasta hekim ili\u015fkisi incelendi\u011finde bu ili\u015fkiyi a\u00e7\u0131klamaya y\u00f6nelik bir\u00e7ok modellemenin \u00f6ne s\u00fcr\u00fcld\u00fc\u011f\u00fcn\u00fc g\u00f6rebiliriz. Szasz ve Hollender 1956 y\u0131l\u0131nda bu ili\u015fkiye y\u00f6nelik; etkinlik-edilgenlik, yol g\u00f6sterme-i\u015f birli\u011fi etme ve kar\u015f\u0131l\u0131kl\u0131 kat\u0131l\u0131m temeline dayanan ili\u015fki olmak \u00fczere 3 t\u00fcr ili\u015fki tan\u0131mlamaktad\u0131r. Bu modelin baz\u0131 noktalarda yetersiz kalmas\u0131 ve birtak\u0131m soru i\u015faretleri do\u011furmas\u0131yla bunlar\u0131 yan\u0131tlamak ad\u0131na 1992 y\u0131l\u0131nda Ezekiel J. Emanuel ve Linda L. Emanuel; Paternalistik, Bilgilendirici, A\u00e7\u0131klay\u0131c\u0131 ve G\u00f6r\u00fc\u015fmeci model olmak \u00fczere 4 t\u00fcr ili\u015fki tan\u0131mlam\u0131\u015flard\u0131r. (1)<\/p>\n\n\n\n<p>Bu modellerden paternalistik veya di\u011fer ad\u0131yla babac\u0131l\u0131k modeli belki de bir\u00e7o\u011fumuzun geleneksel Hipokrat t\u0131p anlay\u0131\u015f\u0131 i\u00e7erisinde s\u0131kl\u0131kla duydu\u011fu ve en \u00e7ok bildi\u011fi model olarak kar\u015f\u0131m\u0131za \u00e7\u0131kmakta. Bu modelde hekim adeta bir gardiyan g\u00f6revini \u00fcstlenerek hastan\u0131n tercihlerinden ba\u011f\u0131ms\u0131z olarak hastan\u0131n g\u00fcvenli\u011fi, sa\u011fl\u0131\u011f\u0131 ve yarar\u0131 ad\u0131na kararlar alan; hasta ise \u2018bilgelikle\u2019 al\u0131nan bu kararlar\u0131 kabul ederek bunlara uyan edilgen bir rol \u00fcstelen ki\u015fi olarak g\u00f6r\u00fclmektedir.&nbsp; Bundan biraz daha farkl\u0131 olan ikinci modelimiz, bilgilendirici modele g\u00f6re hekim bir teknik uzman edas\u0131yla hastay\u0131 bilgilendiren ve hastan\u0131n se\u00e7ti\u011fi m\u00fcdahaleyi uygulayan ki\u015fidir.<\/p>\n\n\n\n<p>A\u00e7\u0131klay\u0131c\u0131 modelde hekim dan\u0131\u015fman g\u00f6revini \u00fcstlenerek hastay\u0131 bilgilendirir ve bilgilendirici modeldekine ek olarak ne istedi\u011fini ger\u00e7ekte tam olarak bilmeyen hastaya ne istedi\u011fini a\u00e7\u0131klayarak hastan\u0131n ihtiyac\u0131na y\u00f6nelik se\u00e7imi yapmas\u0131na yard\u0131mc\u0131 olur.<\/p>\n\n\n\n<p>G\u00f6r\u00fc\u015fmeci modelde ise a\u00e7\u0131klay\u0131c\u0131 modelden farkl\u0131 olarak hekim kendi tercihlerini de ortaya koyar. Hekim bir \u00f6\u011fretmen veya arkada\u015f gibi davran\u0131r, hasta ile kar\u015f\u0131l\u0131kl\u0131 konu\u015farak hangi davran\u0131\u015f veya m\u00fcdahalenin daha iyi olaca\u011f\u0131n\u0131 aktar\u0131r. Hastan\u0131n de\u011fer ve tercihlerini tan\u0131r onun i\u00e7in en iyisini isteyerek ona sadece ne yapabilece\u011fini s\u00f6ylemekle kalmaz ne yapmas\u0131 gerekti\u011fini de anlat\u0131r. Ancak hastan\u0131n karar verme s\u00fcrecinde bir zorlamada bulunmaz. (2)<\/p>\n\n\n\n<p>T\u00fcm bu modeller asl\u0131nda hasta hekim ili\u015fkisinin geli\u015fim ve d\u00f6n\u00fc\u015f\u00fcm s\u00fcrecinde birer mihenk ta\u015f\u0131 olarak bu ser\u00fcvenin \u00f6nemli par\u00e7alar\u0131d\u0131r. Ancak ge\u00e7mi\u015fe uzanan bir yolculu\u011fa \u00e7\u0131kt\u0131\u011f\u0131m\u0131zda \u00e7ok da uza\u011fa gitmeden, bu haklar\u0131n asl\u0131nda \u00e7ok yak\u0131n bir tarihte ete kemi\u011fe b\u00fcr\u00fcnerek resmiyet kazand\u0131\u011f\u0131n\u0131 g\u00f6rebiliriz. 2. D\u00fcnya Sava\u015f\u0131 sonunda ger\u00e7ekle\u015fen Nazi deneylerindeki etik d\u00fczenleme a\u00e7\u0131\u011f\u0131ndan yola \u00e7\u0131karak 1947\u2019de ortaya \u00e7\u0131kan N\u00fcrnberg (Nuremberg) Kodu sonucunda, insan deneylerinde insanlar\u0131n \u00f6zg\u00fcr iradeleriyle, g\u00f6n\u00fcll\u00fcl\u00fck esas\u0131yla onam vermesi gerekti\u011fi \u00f6ne s\u00fcr\u00fclm\u00fc\u015ft\u00fcr. (3) Hukuktaki a\u00e7\u0131klardan do\u011fan ma\u011fduriyetlere kar\u015f\u0131 durmak belki o insanlara fayda sa\u011flamam\u0131\u015f olsa da gelecek nesiller i\u00e7in birer k\u0131v\u0131lc\u0131m olu\u015fturmu\u015ftur. Bu gibi k\u0131v\u0131lc\u0131mlar\u0131n b\u00fcy\u00fcmesi ve \u00e7o\u011falmas\u0131 sonucunda 1957 y\u0131l\u0131nda ABD\u2019de bir malpraktis davas\u0131nda Avukat Paul G. Gebhard ilk defa \u2018ayd\u0131nlat\u0131lm\u0131\u015f onam\u2019 terimini kullanm\u0131\u015f (4) ve bu, 1972 y\u0131l\u0131nda ABD\u2019de mahkeme kararlar\u0131nda bir hak olarak vurgulanm\u0131\u015ft\u0131r. Sonu\u00e7ta ilk hasta haklar\u0131 bildirgesi 1973\u2019te Amerikan Hastaneler Birli\u011fi (AHA) taraf\u0131ndan ilan edilmi\u015ftir (A Patient\u2019s Bill of Rights). G\u00fcn\u00fcm\u00fczde bir\u00e7ok kaynakta, hasta haklar\u0131n\u0131n do\u011fu\u015fu olarak kabul edilen bu tarihte, hasta haklar\u0131n\u0131n hastalara Hastaneler Birli\u011fi yani hekimler taraf\u0131ndan kazand\u0131r\u0131lmas\u0131 ve bu haklar\u0131n g\u00fcn\u00fcm\u00fczde bir\u00e7ok hekim taraf\u0131ndan zaman zaman kendi haklar\u0131n\u0131n k\u0131s\u0131tlamas\u0131 olarak g\u00f6r\u00fclmesi ise sizce de bir hayli dikkat \u00e7ekici ve d\u00fc\u015f\u00fcnd\u00fcr\u00fcc\u00fc de\u011fil midir? Bu bildirge 6 maddeden olu\u015fmakla birlikte ilerleyen y\u0131llarda 1995\u2019te Bali\u2019de yeniden d\u00fczenlenmi\u015f; 2005\u2019te Santiago\u2019da da editoryal olarak g\u00f6zden ge\u00e7irilerek g\u00fcn\u00fcm\u00fczdeki son \u015feklini alm\u0131\u015ft\u0131r. Bu nedenle Bali ve Santiago Bildirgeleri Lizbon II ve III Bildirgeleri olarak da adland\u0131r\u0131lmaktad\u0131r. Lizbon Bildirgesinde temel olarak kaliteli t\u0131bbi bak\u0131m alma, hekim veya sa\u011fl\u0131k kurulu\u015funu se\u00e7me, kendi kaderini tayin etme, bilgilendirilme, gizlilik, onur (haysiyet) hakk\u0131 ve dini yard\u0131m gibi haklara yer verilmi\u015ftir. Buradaki onur hakk\u0131; hasta mahremiyetine sayg\u0131, \u0131st\u0131raptan kurtulma, insanc\u0131l terminal bak\u0131m ve m\u00fcmk\u00fcn oldu\u011funca onurlu ve rahat bir \u00f6l\u00fcm\u00fc kapsarken dini yard\u0131m alma hakk\u0131 ise hastan\u0131n ruhsal ve manevi konfor isteme (dini bir temsilci isteme de buna dahil) veya bunu reddetme hakk\u0131n\u0131 kapsar. Bali ve Santiago Bildirgelerinde ise ilk defa yasal olarak yetersiz hastalar, sa\u011fl\u0131k e\u011fitimi, bilinci kapal\u0131 hastalar ve hastan\u0131n iste\u011fine ayk\u0131r\u0131 giri\u015fimler g\u00fcndeme gelmi\u015f bunlarla ilgili yeni d\u00fczenlemeler getirilmi\u015ftir. (5)<\/p>\n\n\n\n<p>T\u00fcm geli\u015fmeler Lizbon Bildirgeleriyle s\u0131n\u0131rl\u0131 kalmam\u0131\u015ft\u0131r. 1994\u2019te D\u00fcnya Sa\u011fl\u0131k \u00d6rg\u00fct\u00fc\u2019n\u00fcn yay\u0131nlad\u0131\u011f\u0131 Amsterdam Bildirgesiyle hasta haklar\u0131; Sa\u011fl\u0131k bak\u0131m\u0131nda (hizmetlerinde) insan haklar\u0131 ve de\u011ferleri, bilgilendirme, onay, mahremiyet ve \u00f6zel hayat, bak\u0131m ve tedavi, ba\u015fvuru olmak \u00fczere 6 ana ba\u015fl\u0131k halinde ele al\u0131nm\u0131\u015ft\u0131r. (6) Bu bildirgede hastalar\u0131n \u015fik\u00e2yet i\u00e7in ba\u015fvurabilmeleri ile ilgili hususlar\u0131n ana bir ba\u015fl\u0131k alt\u0131nda irdelenmesi de bence hasta haklar\u0131 a\u00e7\u0131s\u0131ndan olduk\u00e7a \u00f6nemli bir de\u011fere sahiptir.<\/p>\n\n\n\n<p>Avrupa Konseyi \u0130nsan Haklar\u0131 ve Biyot\u0131p S\u00f6zle\u015fmesi 1997\u2019de Oviedo \u0130spanya\u2019da imzaya a\u00e7\u0131lm\u0131\u015f ve 1999\u2019da y\u00fcr\u00fcrl\u00fc\u011fe girmi\u015ftir. T\u00fcrkiye de bu s\u00f6zle\u015fmeyi 2003\u2019te kabul etmi\u015f ve b\u00f6ylece 2004\u2019te \u00fclkemizde de y\u00fcr\u00fcrl\u00fc\u011fe girmi\u015ftir. Bu s\u00f6zle\u015fme, g\u00fcn\u00fcm\u00fczde biyomedikal alanda insan haklar\u0131n\u0131n korunmas\u0131na ili\u015fkin yasal olarak ba\u011flay\u0131c\u0131 tek uluslararas\u0131 belge olarak g\u00f6r\u00fclmektedir. Bu s\u00f6zle\u015fmede \u015fu ana kadar bahsetti\u011fimiz bildirgelerden farkl\u0131 olarak insan genomu ve organ aktar\u0131m\u0131 gibi konulara ve bunlarla ilgili d\u00fczenlemelere de de\u011finilmi\u015ftir.
